Cautious management of a community woodland

In the event that a community woodland held in common is declared to be in a legal situation of non-existence, extinction or disappearance of the community of neighbours owning the woodland, the department responsible for forestry will offer its provisional management to the local council in which the woodland is located. If the council declines, the woodland will be provisionally managed by the department responsible for forestry until the community is reconstituted.

In the event that a community woodland is declared to be in a state of serious neglect or degradation, the department responsible for forestry will forward the declaration to the Galician Land Bank, so that the managing body can grant its use and exploitation to private sector initiatives. In this cession, priority will be given to associations in which commoners of the affected community woodland participate, or to other community woodlands that have demonstrated adequate management of their woodlands and are registered in the Register of Active Silviculturists.

Those montes in respect of which the managing entity of the Galician Land Bank reports that there is no private-sector initiative to carry out management will also be provisionally managed by the department responsible for forestry matters through the forestry authority.

In any event, the precautionary management may be carried out by the competent forestry department's own bodies, or by instrumental companies of the autonomous public sector.
